Refund & Cancellation Policy

 

Phnix Tech provides customised digital services including website design, website development, ecommerce development, mobile application development, SEO and digital marketing.

Because many of our services involve customised work performed specifically for a client, our refund and cancellation arrangements depend on the stage of the project and the terms agreed in the applicable quotation or service agreement.

Nothing in this policy is intended to exclude, restrict or modify rights available to consumers under the Australian Consumer Law or any other mandatory applicable law.

 

1. Project Deposits and Initial Payments

 

Where an initial payment or deposit is required to commence a project, that payment may be allocated towards:

  • Project planning
  • Research
  • Design
  • Development resources
  • Project scheduling
  • Initial development
  • Third-party costs
  • Other work undertaken to commence the project

Once work has commenced, the initial payment may not be refundable except where a refund is required under applicable law or specifically agreed in writing.

 

2. Cancellation Before Work Commences

 

If a client requests cancellation before work has commenced, we will review the circumstances and determine the amount, if any, refundable after deducting any non-recoverable costs or work already undertaken, subject to applicable law.

Any refund arrangement will be confirmed in writing.

 

3. Cancellation After Work Has Commenced

 

If the client cancels a project after work has commenced, charges may apply for work completed up to the cancellation date.

This may include:

  • Strategy and planning
  • Design work
  • Development work
  • Content creation
  • Technical implementation
  • Project management
  • Third-party expenses
  • Other approved project costs

Any refundable balance, if applicable, will be calculated based on the work completed and payments already made.

 

4. Custom Website and Application Development

 

Website and application development services involve customised work created specifically for each client.

Accordingly, once substantial design or development work has commenced, a full refund will generally not be available solely because the client changes their mind or no longer wishes to continue.

However, this does not affect any rights or remedies the client may have under Australian Consumer Law.

 

5. Digital Marketing and SEO Services

 

For recurring SEO, Google Ads, social media marketing or other digital marketing services, cancellation arrangements will be governed by the applicable service agreement.

Work already completed, advertising spend already incurred, third-party charges and other approved costs are generally not refundable.

Advertising budgets paid directly to third-party platforms may also be subject to those platforms' own refund policies.

 

6. Client Delays

 

Where project delays occur because the client has not provided required content, approvals, information, access credentials or feedback, such delays will not automatically create a right to a refund.

If a project remains inactive for an extended period because of client-side delays, we may require the project to be rescheduled based on our current availability.

 

7. Scope Changes

 

A request to substantially change the approved project scope does not automatically qualify for a refund.

Where additional work is requested, we may provide a revised quotation or change order before commencing that work.

 

8. Defects and Corrections

 

If a delivered website, application or other agreed deliverable contains an issue that falls within the agreed scope, please notify us promptly.

We will investigate the issue and, where appropriate, correct defects attributable to our work in accordance with the applicable agreement.

Issues caused by third-party software, hosting, plugins, client modifications or changes made outside our control may be handled separately.

 

9. Refunds Required by Law

 

Nothing in this policy limits a client's rights under applicable consumer protection legislation.

Where Australian Consumer Law requires a refund or other remedy, Phnix Tech will provide the applicable remedy in accordance with the law. Australian consumer guarantees can provide remedies where services fail to meet required guarantees, including circumstances involving major failures.

 

10. How to Request a Refund or Cancellation

  • Full name
  • Business name
  • Project/service name
  • Invoice or quotation number, if available
  • Date of payment
  • Reason for the request
  • Relevant supporting information

We may contact you for additional information before making a decision.

 

11. Refund Processing

 

Where a refund is approved, we will generally process it using the original payment method where reasonably practicable.

Processing times may depend on the payment provider or financial institution.

 

12. Third-Party Costs

 

Payments made to third-party providers, including hosting companies, domain registrars, software providers, advertising platforms, plugins, APIs or other external services, may be subject to those providers' own refund policies.

Where we have paid such costs on your behalf, they may not be recoverable from the third-party provider.
